These Terms and Conditions define the conditions under which Les Remarquables provides its services to users of my-lodge.com and the My Lodge application.
1. About Us
Les Remarquables, a French SARL with a share capital of €5,000, registered office at 144 rue Paul Bellamy, 44000 Nantes, France, registered with the Nantes Trade and Companies Register under number 437 574 163 — SIRET: 437 574 163 00071 (hereinafter the "Company"). The Company offers the following services: development and publishing of collaborative software, online and mobile.
2. Preamble
The Company invites its Users to carefully read these Terms and Conditions of Sale and Use (hereinafter "T&Cs"). The T&Cs apply to all Services provided by the Company to its Customers, regardless of any clauses that may appear in the Customer's own documents.
The T&Cs are provided to any Customer who requests them. The Customer must read the T&Cs before placing any Order. In the event of subsequent changes to the T&Cs, the Customer is subject to the version in effect at the time of their Order.
3. Definitions
"Customer" means any natural or legal person who places an Order on this Website;
"Order" means any order placed by a registered User on this Website;
"T&Cs" means these Terms and Conditions of Sale and Use;
"Consumer" means an individual buyer acting outside their professional capacity;
"Professional" means a legal or natural person acting in the course of their professional activity;
"Services" means all services offered to Users by the Company through this Website;
"Website" means this website, namely www.my-lodge.com;
"Company" means Les Remarquables;
"User" means any person who uses the Website.
4. Registration
Registration on the Website is open to all legal or natural persons who are of legal age and have full legal capacity. Use of the Services is conditional on registration, which is free of charge.
Users warrant and declare on their honour that all information provided is accurate and true. Each registered User has a strictly personal and confidential username and password. The Company shall not be liable for any identity theft of a User.
5. Services and Pricing
The Services subject to the T&Cs are those listed on the Website. The price shown corresponds to the price in euros including all taxes (VAT included) and takes into account any applicable discounts on the day of the Order.
The Company reserves the right to modify its prices at any time. It undertakes to charge the price applicable at the time the Order is placed.
6. Orders
Orders can only be placed by registered Users. An Order is registered when the Customer accepts the T&Cs by checking the appropriate box and validates their Order. The Customer will receive email confirmation once the Order is placed.
In the event of payment default or incorrect address, the Company reserves the right to block the Order until the issue is resolved.
7. Payment Terms
Unless otherwise stated, all sales are paid in full at the time of the Order. Payments are processed securely via Stripe (Stripe, Inc. / Stripe Payments Europe, Ltd.), a PCI DSS Level 1 certified payment provider. Payment can be made by:
Credit/debit card (Visa, Mastercard, American Express)
SEPA Direct Debit (for annual subscriptions)
My Lodge never stores your payment details; these are managed exclusively by Stripe. In the event of late payment, Professional Customers will incur a late payment penalty at the rate set by the European Central Bank plus 10 percentage points. For Consumer Customers, the penalty is calculated at the legal interest rate.
8. Service Delivery
The Company undertakes to use all human and material resources to deliver the service within the announced timeframes. If services have not been performed within the agreed deadline, the Customer may request cancellation of the sale under the conditions set out in articles L216-2 and L216-3 of the French Consumer Code. Any sums paid will be refunded within fourteen days of the contract termination notice.
9. Claims
For all Orders placed on this Website, the Customer has a 10-day period from the date of service delivery to submit a claim. Claims must be sent to contact@my-lodge.com with supporting documents.
10. Consumer Right of Withdrawal
The Consumer has a 14-day right of withdrawal from the date of the Order, except for products listed in article L221-28 of the French Consumer Code, including:
Services fully performed before the end of the withdrawal period, with the Consumer's prior express consent;
Digital content not supplied on a tangible medium whose performance has started with the Consumer's prior express consent.
To exercise this right, the Consumer sends a statement to: contact@my-lodge.com. The refund will be made within 14 days of the Company receiving the withdrawal notice.
11. Personal Data Processing
Registration on the Website involves processing the Customer's personal data, in compliance with GDPR 2016/679 and French Data Protection Act. The Customer has the right at any time to access, rectify, object to, or erase their personal data by writing to: contact@my-lodge.com.
12. Data Sharing
The Website may use third-party companies for certain operations. These third parties have access to the collected data only for the purpose of performing a specific task. The Website remains responsible for the processing of this data.
Customer information may be transmitted to third parties without prior consent only to: comply with the law, protect against serious bodily harm, combat fraud, or protect the Company's property rights.
13. Data Protection
The Company ensures an appropriate level of security proportional to the risks involved, in accordance with GDPR 2016/679. However, these measures do not constitute a guarantee and do not impose a results obligation on the Company regarding data security.
14. Cookies
To provide optimal navigation, the Company may place a cookie on the User's device to store information relating to navigation on the Website.
The User may block, change the storage duration, or delete this cookie via their browser settings. If disabling cookies prevents use of certain Website services, this does not constitute damage giving rise to any right to compensation.
15. Modifications
The Company reserves the right to modify the Website, the services offered, the T&Cs, and any delivery procedure. When placing an Order, the User is subject to the T&Cs in effect at the time of the Order.
16. Liability
The Company cannot be held liable for the temporary or permanent unavailability of the Website. The Company reserves the right to make the Website unavailable for updates, improvements, or maintenance operations.
17. Intellectual Property
The trademark, logo, and visual identity of this Website are trademarks registered with the INPI and protected works under intellectual property law, owned exclusively by the Company. Any unauthorized reproduction or exploitation will expose the infringer to civil and criminal proceedings.
18. Jurisdiction
These T&Cs are governed by French law. Any dispute between the Company and a User shall first be subject to an attempt at amicable resolution. Failing that, disputes shall be referred to the competent courts of Nantes, France.
The Customer may use conventional mediation through the Consumer Mediation Commission (Article L534-7 of the French Consumer Code) or any other alternative dispute resolution method.
19. Pre-contractual Information
Prior to their Order, the Customer acknowledges having received, in a clear and understandable manner, the T&Cs and the information required by articles L111-1 to L111-7 of the French Consumer Code, including: essential characteristics of Services, pricing, delivery timeline, Company identity, legal guarantees, mediation options, and right of withdrawal.

Mobile Subscription
The My Lodge app is subject to an automatically renewing subscription. Payment is processed via the App Store (iOS) or Google Play (Android) account upon confirmation.
The subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can deactivate it in your App Store or Google Play account settings.
Any unused portion of a free trial period will be forfeited when the user purchases a paid subscription.
