These “Acacia” Special Terms (the “Acacia Terms”) supplement the General Terms of Sale and Use (the “GTSU”) of LES REMARQUABLES, EI. They apply as soon as the User accesses the Acacia area or uses any of its features. In the event of conflict, the Acacia Terms prevail with respect to the Acacia area. The French version is authoritative.
Acacia is a premium community area reserved for members whose status has been verified (the “Verified Members”). It allows, in particular, publishing and viewing directory profiles, classified ads, papers, messages, photographs, and requesting or offering geolocated mutual help (together, “User Content”).
Verification is purely declarative and relies on the items provided by the User. It is a mere plausibility check and does not constitute identity certification, proof of membership, or any warranty as to a User’s status, degree, obedience or masonic regularity. The Company may grant, refuse, suspend, revoke or let a verification expire at any time and at its sole discretion, including in case of doubt, report, non-compliant document or failure to renew annually, with no right to compensation. The Company shall not be liable for the consequences of a verification wrongly granted or refused, or for the impersonation of a third party.
The User is solely and fully responsible for the User Content they publish or share via Acacia, including texts, photographs, images, contact details and data. The Company exercises no prior editorial control and is neither the author nor the editor of such Content.
By publishing Content, the User warrants that: they hold all necessary rights or authorisations (including intellectual property rights and the image rights of the persons depicted); the Content is lawful and accurate and does not infringe third-party rights or public order; it contains nothing unlawful, defamatory, insulting, violent, hateful, discriminatory, infringing or misleading; it does not disclose third-party personal data without consent or information subject to a duty of discretion; and it respects the discretion customary in the masonic context. The User shall indemnify and hold the Company harmless against any third-party claim arising from such Content.
With respect to User Content, the Company acts as a host within the meaning of Article 6-I-2 of French Law no. 2004-575 of 21 June 2004 (LCEN). It has no general obligation to monitor stored content and cannot be held liable for such content unless it had knowledge of its manifestly unlawful nature and failed to act promptly to remove it.
Any manifestly unlawful Content may be reported to abus@my-lodge.com (or via the in-app report/delete feature). The Company may remove or disable any reported Content without notice and at its sole discretion.
The mutual-help feature connects Members based on location data provided with their consent. The resulting exchanges, meetings and assistance are the sole responsibility of the Members concerned and take place at their own risk. The Company merely provides the connection tool, is not a party to these relationships and cannot be held liable for any damage or misconduct arising therefrom.
Ads are published under the sole responsibility of their author. Any transaction is concluded directly between Members: the Company is not a party, receives no price, provides no warranty, conformity, delivery or payment, and cannot be held liable for any dispute between Members.
Published papers and texts remain the property of their author, who warrants being the author or holding the necessary rights. The Company does not guarantee the accuracy, originality or “orthodoxy” of the content, which binds only its author and does not constitute advice from the Company.
To enable the service, the User grants the Company a non-exclusive, royalty-free, worldwide licence to host, reproduce, display and distribute their Content within the application for the duration of its publication. Deletion of the Content ends this licence, subject to residual technical copies and backups.
Certain features process specific data: location and address (mutual help, directory), and a photograph of a supporting document (verification). The document photograph is deleted after processing. Mutual-help requests, containing contact and location data, are kept for a limited time then automatically deleted. These processing operations comply with the GDPR and the Company’s privacy policy; the User has the rights of access, rectification, objection and erasure described in the GTSU.
The Company may, at any time and without notice, remove Content, restrict or suspend access to Acacia, revoke verification or close a User’s account in case of breach, founded report or risk to other Users, with no right to compensation.
To the extent permitted by law, the Company shall not be liable for User Content, relationships between Members, exchanged information, or the consequences of verification. The Acacia service is provided “as is”, without warranty as to the completeness or accuracy of User-published content.
Accessing Acacia and publishing any Content constitutes full acceptance of these Acacia Terms, which supplement the GTSU. Failing acceptance, the User must refrain from using the Acacia area.
Mason status is verified by humans and renewed every year. The Company does everything possible to ensure its reliability and works closely with the Obediences to continually strengthen security. However, the Company cannot be held liable in the event of identity theft, forged documents or fraudulent statements by a third party. Security remains our absolute priority.
